1. Acceptance of Terms

By accessing or using the Eriol application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you must not use the Service. Your continued use of the Service after any modifications to these terms constitutes your acceptance of the revised terms. These terms apply to all users of the Service, including contributors, browsers, and customers.

2. Eligibility

You must be at least 18 years of age to create an account and use the Service. By registering for an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are under 18 years of age, you may not use the Service. Eriol does not knowingly collect information from or direct its services to individuals under the age of 18. If we become aware that a user is under 18, we reserve the right to terminate their account and delete any associated data without notice.

3. Description of Service

Eriol provides a suite of streaming tools including a desktop application for live broadcasting, multi-platform streaming, local recording, screen sharing, and optional self-hosted or cloud-based server infrastructure. The Service is provided on an "as available" basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

4. Third-Party Integrations

Eriol integrates with third-party platforms including, but not limited to, Twitch, Kick, and YouTube. When you connect a third-party account, the Service retrieves limited information necessary for functionality, specifically your stream key, user ID, and display name. We do not access or store additional data from these platforms beyond what is required to deliver the streaming service. Your use of third-party platforms is subject to their respective terms of service and privacy policies. Eriol is not responsible for the practices, policies, or availability of any third-party services.

5. User Responsibilities

You are solely responsible for your use of the Service and for any content you stream, record, or distribute through it. You agree not to use the Service for any illegal, harmful, or unauthorized purposes. You must not transmit content that infringes on intellectual property rights, contains malware, promotes violence or hatred, or violates any applicable laws or regulations. You are responsible for maintaining the security of your account credentials, including your password and any two-factor authentication methods, and for all activity that occurs under your account.

6. Intellectual Property

The Service, including its original content, features, functionality, design, and underlying technology, is and remains the exclusive property of Eriol and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, or otherwise exploit any part of the Service without our prior written consent. Your content remains your own — Eriol does not claim ownership of any streams, recordings, or media you create using the Service.

7. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

8. Refunds and Cancellations

All purchases of Eriol subscription plans are processed by our merchant of record. You may request a full refund within 7 (seven) calendar days of the initial purchase or first renewal of any subscription, for any reason, by contacting info@eriol.io with your purchase details. After this 7-day period, all sales are final and no refunds will be issued for the remainder of the billing cycle, except where required by applicable law.

You may cancel your subscription at any time from your account dashboard or by contacting support. Cancellation takes effect at the end of the current billing period and prevents further renewals, but does not entitle you to a prorated refund for the unused portion of the current period.

9. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied. Eriol disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Service is free of viruses or other harmful components. You use the Service at your own risk.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Eriol and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service. This limitation applies regardless of whether the damages are based on warranty, contract, tort, negligence, strict liability, or any other legal theory, and whether or not Eriol has been advised of the possibility of such damages. In no event shall our total liability exceed the amount you have paid to Eriol in the twelve months preceding the claim.

11. Changes to Terms

We reserve the right to modify these Terms of Service at any time. When we make changes, we will provide at least 30 days' notice before the new terms take effect by posting the updated terms on our website and updating the "Last Updated" date. Your continued use of the Service after the effective date of the revised terms constitutes your acceptance of the changes. If you do not agree to the modified terms, you must stop using the Service before the changes take effect.
